7. 1898, 24 Jan: tombstone record at Valley Grove cemetery, near Armstrong, Erath Co, TX. (need clarification on the name of this cemetery).

SECONDARY SOURCES:

1. "Smithsonian" (magazine), June 1998, Vol. 29, #3, page 96: "Hang'em First, Try'em Later": "As "the only law west of the Pecos", Judge Roy Bean practiced a legendary -- and outrageous -- brand of frontier justice.", by Bruce Watson.
page 102: "Many of Bean's rulings were amusing, but there's nothing fun about getting away with murder. Or getting your son off for murder. Sam Bean was the youngest and wildest of Roy's five children. One day in the saloon, a certain Mr. George Upshaw made fun of Sam's fine Mexican blanket. The two men argued, and Upshaw slapped Sam in the face, drawing blood. Roy said simply, "Shoot him, Sam -- shoot him." Obeying his father, Sam blew the man away. For the next year, Roy corralled witnesses and promised favors. In a Del Rio courtroom in 1899, Sam Bean was acquited. The verdict, a Langtry old-timer remembered, cost Roy "many a bottle of beer" and nearly all the money he'd managed to save."

COMMENTS:

1. Information from Tom Upshaw, Animas, NM. (in 1980s)

2. Information from Charlie Upshaw, Winkleman, AZ. (in 1980s)

3. There is some confusion of the names of the cemeteries where George Augustus Upshaw is buried (Valley Grove Cemetery, near Stephenville, Erath Co, TX) & where George Roane Upshaw is buried (Valley Grove Cemetery, near Armstrong, Erath Co, TX). Are these two different cemeteries or actually the same? The three volumes of Erath Co, TX, cemeteries were checked for Upshaw and printed in the UFJ, vol, II, page 63 but, at that time, G.A. Upshaw was not reported as being in the three vols. This needs clarification.

4. Cara Rae, in a 1998 memo to the Upshaw mail list, states "I visited Langtry, Texas, in March 1998 to "see where it all happened". I visited George Roane Upshaw's grave and found the lot where the Upshaw house once stood. The house next door to it is still standing and once was home to Charles Upshaw, G.R.'s son. As for Judge Roy bean's infamous "Jersey Lilly" saloon, the one that's there now is not the original. The original Jersey Lilly was burned to the ground after Sam Bean was acquitted of murdering George Roane Upshaw. There's been some speculation that "the Upshaw boys" did it in retaliation for their father's murder - knowing the family, it could be true."
